General Terms and Conditions (GTC) of Aluwatt GmbH

§1 Scope

(1) These GTC apply to all business relationships between Aluwatt GmbH and its customers (hereinafter “Customer”) in the version valid at the time of the contract conclusion.

(2) Deviating or supplementary terms of the Customer only apply if Aluwatt has expressly agreed to them in writing.

§2 Conclusion of Contract

(1) Product presentations on Aluwatt’s website are not binding offers.

(2) The Customer can place products in the shopping cart and submit a binding order request by clicking “Buy Now.”

(3) Aluwatt sends an automatic receipt confirmation, which does not constitute contract acceptance. The contract is concluded upon Aluwatt’s acceptance via a separate email.

§3 Delivery and Product Availability

(1)Delivery times are calculated from the order confirmation date, subject to prior payment.

(2) If a product is unavailable at the order time, Aluwatt will inform the Customer immediately. No contract is formed if the product is permanently unavailable.

(3) If the product is temporarily unavailable, Aluwatt will notify the Customer accordingly.

§4 Retention of Title

Products remain Aluwatt’s property until fully paid.

§5 Prices and Shipping Costs

(1) All prices include the applicable VAT

(2) Shipping costs are borne by the Customer unless the right of withdrawal is exercised.

(3) Shipping is done via postal service, with Aluwatt bearing the shipping risk for consumers.

§6 Payment Terms

(1) Customers may pay via bank transfer, credit card, or other specified methods.

(2) The Customer can change the payment method in their user account.

(3)Payment is due immediately upon contract conclusion. Late payments incur default interest.

§7 Warranty, Guarantee

(1) Aluwatt is liable for defects according to legal provisions.

(2) Additional guarantees only apply if explicitly stated.

§8 Liability

(1) Claims for damages are excluded, except for injuries to life, body, or health, or breaches of essential contractual obligations.

(2) Aluwatt’s liability for breaches of essential obligations is limited to foreseeable damages.

(3) Product Liability Act provisions remain unaffected.

§9 Right of Withdrawal

(1) Consumers have a statutory right of withdrawal.

(2) If the withdrawal right is exercised, the Customer bears the return shipping costs.

(3) Detailed withdrawal terms are provided in the withdrawal notice.

§10 Data Protection

(1) Aluwatt processes personal data according to legal requirements.

(2) Personal data provided for order purposes are used for contract fulfillment and handling.

(3) Customers have the right to access, correct, block, and delete their stored personal data.

§11 Final Provisions

(1) German law applies to contracts between Aluwatt and the Customer.

(2) For merchants, the jurisdiction for disputes is Aluwatt’s registered office.

(3) If any provision is invalid, the remaining provisions remain effective. Invalid provisions are replaced by statutory regulations.
